1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Volcast mobile application and website ("Service") operated by Volcast ("we", "us", "our").

By creating an account, downloading the app, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Volcast is a solar energy forecasting application that:

• Generates PV production forecasts based on your system configuration, location, and weather data
• Provides auto-calibration to improve forecast accuracy over time
• Offers smart notifications about forecast changes and optimal energy usage windows

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to create an account and use the Service. By registering, you represent that you meet this requirement.

3.2 Account Security

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately at hello@volcast.app of any unauthorized use

Passwords must be at least 8 characters. We enforce rate limiting on login attempts to protect your account.

3.3 One Account Per Person

Each person may maintain one account. We reserve the right to merge or remove duplicate accounts.

4. Free and Premium Tiers

4.1 Free Tier

The free tier includes:

• 2-day PV production forecast
• Basic system configuration
• Manual production logging

4.2 Premium Tier

The premium tier is available as a one-time purchase (no subscription) and includes:

• 7-day PV production forecast
• Auto-calibration features
• All future premium features

4.3 Purchases

Premium purchases are processed through the Apple App Store or Google Play Store. All purchases are subject to the respective store's terms and refund policies:

• Apple: Refund requests must be submitted through Apple. See Apple's refund policy.
• Google: Refund requests must be submitted through Google Play. See Google's refund policy.

We do not process payments directly and cannot issue refunds outside of the app store mechanisms.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service, other accounts, or our servers
• Reverse engineer, decompile, or disassemble the app or its backend services
• Scrape, crawl, or automatically extract data from the Service
• Use the Service to send spam, phishing messages, or unsolicited communications
• Impersonate another person or entity
• Interfere with or disrupt the Service or servers
• Circumvent rate limiting, authentication, or other security measures
• Share your account credentials with others or allow third-party access to your account
• Use the Service through automated bots or scripts without prior written permission

6. Third-Party Integrations

6.1 Weather Data

Forecast generation relies on weather data from Open-Meteo, a third-party weather API. Weather data accuracy and availability are outside our control. Interruptions in weather data services may temporarily affect forecast availability.

6.2 Push Notifications

Push notifications are delivered through Expo Push Service, Firebase Cloud Messaging (Android), and Apple Push Notification Service (iOS). Delivery reliability depends on these third-party services, your device settings, and network conditions.

7. Intellectual Property

7.1 Our Rights

The Service, including its design, code, algorithms, graphics, logos, trademarks, and content, is the intellectual property of Volcast and is protected by applicable copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any data you provide to the Service (system configuration, production data, preferences). By using the Service, you grant us a limited license to process this data solely for the purpose of providing and improving the Service.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, and incorporate such feedback into the Service without obligation to you.

8. Disclaimers

8.1 Forecast Accuracy

Forecasts are provided for informational purposes only. Do not make financial commitments, energy trading decisions, or critical operational decisions based solely on Volcast forecasts.

8.2 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be:

• Uninterrupted, timely, secure, or error-free
• Accurate, reliable, or complete
• Free of viruses or other harmful components
• Available in all geographic regions

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Volcast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or 50 EUR, whichever is greater.
• We are not liable for damages arising from: inaccurate forecasts, weather data errors, third-party service outages, unauthorized access due to your failure to secure your credentials, or force majeure events.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Volcast and its representatives from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Actions taken through your account by you or anyone you authorize

11. Account Termination

11.1 Termination by You

You may delete your account at any time from Settings > Account > Delete Account in the app, or by emailing hello@volcast.app. Upon deletion, your personal data will be permanently removed from our servers within 30 days, as described in our Privacy Policy.

11.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our Privacy Policy
• Engage in fraudulent, abusive, or illegal activity
• Attempt to circumvent security measures or abuse the Service
• Create multiple accounts in violation of Section 3.3

We will make reasonable efforts to notify you before termination, except in cases of serious violations where immediate action is necessary. If your account is terminated by us, you may request a copy of your data within 30 days of termination.

11.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Your data will be deleted per our retention policy
• Premium purchases are non-refundable upon termination for Terms violation
• Sections 7, 8, 9, 10, and 13 survive termination

12. Modifications to Service and Terms

12.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes that affect your use of the Service.

12.2 Terms Changes

We may update these Terms from time to time. When we make material changes:

• We will update the "Last updated" date
• We will notify you via push notification or email
• Continued use of the Service after 30 days constitutes acceptance

If you do not agree with the updated Terms, you should stop using the Service and delete your account.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through:

1. Informal resolution: Contact us at hello@volcast.app and we will attempt to resolve the dispute informally within 30 days.
2. EU Online Dispute Resolution: Consumers in the EU may submit complaints through the EU ODR platform.
3. Jurisdiction: If informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the courts in Poland.

Nothing in these Terms limits your rights under mandatory consumer protection laws in your country of residence.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Volcast regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign or transfer your rights under these Terms without our consent. We may assign our rights without restriction.
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, pandemic, power outages, or third-party service failures.
